Terms of Service

These Terms ("Terms") are a binding agreement between you and Thalamura ("we", "us") that govern your use of the Thalamura web app, mobile web app, and installable (PWA) version at thalamura.com (together, the "Service"). By creating an account, signing in with Google, or using guest mode you confirm you have read and accepted these Terms and our Privacy Policy.
1. Eligibility
You must be at least 13 years old (or the age of digital consent in your country) to create an account. Parents and family members may add minors as people in a tree, but minors should not create their own accounts.
2. Your account
- You are responsible for keeping your sign-in credentials secure.
- You are responsible for activity that happens under your account.
- You must give accurate information when creating an account.
- Guest accounts (no email) are intended for trial use and may be deleted automatically after 14 days of inactivity.
3. Acceptable use
When using Thalamura you agree not to:
- Add false, defamatory or harmful information about real people.
- Harass, threaten, defame, dox or surveil others through trees, messages or AI prompts.
- Upload illegal content, CSAM, hate speech, or content that infringes copyright or privacy.
- Attempt to access trees, accounts, messages, or AI conversations you have not been invited to.
- Probe, scan, scrape, reverse engineer, rate-limit-bust or otherwise abuse the Service or its AI features.
- Use Thalamura to send spam, including via invites or push notifications.
4. Family content & invites
When you add a relative to a tree or invite them to join, you represent that you have a legitimate family-history reason to do so and that you will respect their wishes about how their information is shared. Other family-tree members can edit and contribute to the shared tree; you remain in control of content you personally created and can delete it at any time.
5. Your content & licence
You retain ownership of everything you upload — names, dates, stories, photos, audio, messages. You grant Thalamura a non-exclusive, worldwide, royalty-free licence to host, transmit, back up and display that content solely to operate the Service for you and the family members you have shared it with. This licence ends when you delete the content or your account (subject to the retention windows in the Privacy Policy).
6. AI features
The in-app AI assistant uses third-party large language models to generate suggestions, stories, summaries and answers based on your family context. AI output can be inaccurate, incomplete or biased — always verify important details before relying on them. You are responsible for what you do with AI output. We log AI prompts and responses for up to 90 days to help with safety, debugging and abuse prevention, and you can review or delete them from AI privacy inside the app.
7. Messaging & notifications
Direct messages and channel messages are delivered to the members you select. Push notifications are opt-in and can be revoked from your browser, OS, or account settings. Transactional emails (invites, security alerts, account notices) are part of the Service and cannot be unsubscribed from while your account exists.
8. Cancellation & deletion
You can delete your account at any time from your account. Deletion is reversible for 30 days — sign back in and tap "Keep my account". After 30 days your personal data is permanently removed as described in the Privacy Policy. Family-tree content that other members have contributed to may remain visible to those members.
9. Service availability
Thalamura is provided "as is" and "as available". We work hard to keep it up and your data safe, but we do not guarantee uninterrupted or error-free service. We may add, remove or change features and may suspend the Service for maintenance.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Thalamura is a memory-keeping tool — it is not a legal, medical, genealogical or DNA-testing service and AI output is not professional advice.
11. Limitation of liability
To the maximum extent permitted by law, Thalamura is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Our aggregate liability for direct damages is limited to the amount you have paid us in the 12 months before the claim (or, if you have not paid us, the equivalent of USD 50).
12. Suspension & termination
We may suspend or terminate access to the Service if you breach these Terms or use the Service in a way that risks harm to others or to Thalamura. Where reasonable we will give notice and an opportunity to fix the problem first.
13. Changes
These Terms may evolve as the product evolves. Material changes will be communicated via the app or email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which Thalamura is established, without regard to conflict-of-laws rules. Mandatory consumer-protection rights in your country of residence are unaffected.
